■PRiVACE Seat Booking Website Membership Terms (For Customers Using the Service as Members)

[General Provisions]

Article 1

  1. The purpose of these Terms shall be to stipulate the content, applicable conditions, etc. of the registration-type service (hereinafter, the “Service”) related to the seat booking website (hereinafter, the “Booking Website”) of the seat reservation service “PRiVACE” provided by Hankyu Corporation (hereinafter, the “Company”) in order to improve convenience for users.
  2. These Terms shall apply to customers who have completed registration for the use of a common account (hereinafter, “Common ID”) of the Hankyu Hanshin Group that enables them to receive services provided by the Hankyu Hanshin Holdings Group and its partners, including “HH cross ID.” (Customers who have completed registration for the use of a Common ID shall hereinafter be referred to as “Common ID Members.”)
  3. Common ID Members can purchase the Company’s reserved seat tickets by using the Service.

[Scope of Application]

Article 2

  1. The content, applicable conditions, etc. of the Service shall be as provided in these Terms.
  2. Matters not stipulated in these Terms shall be as provided by laws and regulations and the Company’s Passenger Service Rules, Rules for Handling Reserved Seat Tickets, etc. (hereinafter, “Service Rules, etc.”).
  3. The Service Rules, etc. set forth in the preceding paragraph shall be effective together with these Terms. In the event of any discrepancy between these Terms and said Service Rules, etc., the Service Rules, etc. shall prevail.

[Common ID Members]

Article 3

  1. Common ID Members who wish to purchase reserved seat tickets through the Service can use the Service by agreeing to comply with these Terms, thereby completing a service use agreement. Common ID Members who use the Service shall hereinafter be referred to as “Members.”
  2. If any provision hereof overlaps with or differs from those of the “Hankyu Hanshin Group Common ID Member Terms of Use” (hereinafter, the “Common ID Member Terms of Use”), these Terms shall prevail.
  3. If a Common ID Member withdraws from membership, or if the use of a Common ID is suspended or membership is forfeited due to such reasons as violation of these Terms or the provisions separately stipulated in the Common ID Member Terms of Use, he/she shall no longer be able to use the Service.
  4. Members shall be obligated to faithfully comply with these Terms as well as general etiquette, morals, and technical rules for the use of the Internet. Any person whose use of the Service is suspended or whose Common ID membership is forfeited due to violation of these Terms or applicable rules may be refused use of the Service itself.

[Meanings of Terms]

Article 4

  1. The meanings of the main terms used in these Terms shall be as follows.
    • (1) Information terminal
      An information terminal, such as a smartphone, tablet, or PC, that is connected to the Internet and can successfully be connected to the Booking Website of the Service
    • (2) Online booking
      Purchasing or changing reserved seat tickets on the Booking Website using the Service
    • (3) Purchase number
      A unique number assigned to each purchase of reserved seat tickets on the Booking Website
    • (4) Ticket information
      Information displayed on the screen of an information terminal or on printed material, including the boarding date, train number, boarding section, and seat number, based on the information on the purchase of a reserved seat ticket through online booking
    • (5) Points
      “PRiVACE points,” which are granted by purchasing reserved seat tickets through the Service. Points can be used to pay seat reservation fees.
    • (6) Reserved seat car
      A car that requires a valid reserved seat ticket when boarding it
    • (7) Reserved seat train
      A train that has reserved seat cars among the cars consisting of it
    • (8) Connecting train
      A train on the Company’s line that is taken up to a boarding station to arrive at the station reasonably in time for the departure time indicated on the timetable of the station, for the purpose of using a reserved seat train for which online booking has been made
    • (9) Login
      Entering a Common ID and password to make it possible to use the functions provided by the Booking Website

[Responsibility of Members]

Article 5

  1. Members shall be solely responsible for managing information on the purchase of reserved seat tickets. Members shall be responsible for the operation of information terminals they perform, regardless of whether or not they perform the act themselves or whether or not they are negligent. If a Member causes any damage to a third party in using the Service, he/she shall resolve any dispute arising with the other party at his/her own responsibility and expense.
  2. If a Member violates these Terms and causes any damage to the Company, the Company shall claim compensation from said Member for all damage it suffers, and said Member shall accept the claim.

[Usage Environment]

Article 6

  1. Members shall prepare and maintain, at their own responsibility and expense, the information terminals, software, communication services provided by telecommunications carriers, and other equipment necessary to use the Service.
  2. Members shall be responsible for paying communication costs, etc. necessary to use the Service.
  3. Information terminals shall be subject to the condition that the Booking Website is displayed properly in accordance with the prescribed specifications. If information terminals are not ready for use due to such reasons as their failure, dead battery, or unstable status of communication services provided by telecommunications carriers, part or all of the Service cannot be used. Additionally, depending on the type of information terminal used by Members or the security level supported by their browsers, the Service may not be available to them.

[Available Hours for the Service]

Article 7

  1. The Service shall be available twenty-four (24) hours a day; provided, however, that maintenance can be performed on a date and at a time determined by the Company, and in the event of any change in the available hours due to said maintenance, prior notice shall be given.
  2. The time used for the Service shall be based on Japan Standard Time.

[Use of the Service]

Article 8

  1. The Service can be used by logging into the Booking Website using the Common ID and password registered for use.
  2. The Booking Website uses cookies to improve its convenience. For more information, please see “Handling of Customers’ Access Information on the Website” in the Company’s privacy policy.
  3. The Service shall not be available to anyone under sixteen (16) years of age.

[Purchase of Reserved Seat Tickets]

Article 9

  1. By operating information terminals by themselves on the Booking Website, Members can purchase reserved seat tickets from fourteen (14) days before the date of boarding the reserved seat train they wish to use up to one (1) minute before the departure time indicated on the timetable of the boarding station on the day of boarding.
  2. Members can purchase tickets for up to four (4) seats at once for use by more than one (1) person, provided that they are used for the same itinerary (same day, same train, and same section).
  3. The Company shall assign a purchase number to a Member for whom the purchase of reserved seat tickets has been completed and shall give notification by email to the email address registered in his/her Common ID membership information. In such case, the Member shall be deemed to have received said notification.

[Prohibition of Resale of Reserved Seat Tickets]

Article 10

  1. Resale of reserved seat tickets purchased by Members shall be prohibited. If the Company confirms the resale of reserved seat tickets, it can take such measures as suspending the use of the Service by the relevant Member without prior notice, suspending the Common ID of the relevant Member, or revoking the membership of the relevant Common ID Member. The Company shall not be liable for any disadvantage or damage caused to any Member as a result of such measures.

[Payment Method]

Article 11

  1. The payment of seat reservation fees for reserved seat tickets purchased through the Service shall be made using a payment service offered by a payment service provider. The types of available payment methods shall be as follows:
    • (1) Credit card payment
    • (2) Code payment
  2. If tickets for more than one person are purchased at once, the same payment method shall be applied to all seats.
  3. Members can convert one (1) point to one (1) yen to use their points to cover all or part of the payment amount.

[Change of Train on the Same Date]

Article 12

  1. By operating information terminals by themselves on the Booking Website, Members can change their seat of a reserved seat train for which online booking has been made to a different section in the same direction, or to a seat and section of a different train in the same direction on the same boarding date that is on sale at the time (hereinafter, “Change of Train on the Same Date”), up to one (1) minute before the departure time of the reserved seat train, which is indicated on the timetable of the boarding station.
  2. A Change of Train on the Same Date shall be made simultaneously for all seats for each purchase number.
  3. A Change of Train on the Same Date can be made as many times as necessary for each purchase number.
  4. The Company shall give notification by email to the email address registered in the Common ID membership information of the Member for whom the handling of a Change of Train on the Same Date has been completed. In such case, the Member shall be deemed to have received said notification.

[Change of Train Seat]

Article 13

  1. By operating information terminals by themselves on the Booking Website, Members can change their seat of a reserved seat train for which online booking has been made to a different seat of the same train that is on sale at the time, or to a seat and section of a different train that is on sale at the time and that does not fall under Paragraph 1 of the preceding Article (hereinafter, “Change of Train Seat”), up to one (1) minute before the departure time of the reserved seat train, which is indicated on the timetable of the boarding station.
  2. A Change of Train Seat shall be made simultaneously for all seats for each purchase number.
  3. A Change of Train Seat can be made only once for each purchase number.
  4. The Company shall give notification by email to the email address registered in the Common ID membership information of the Member for whom the handling of a Change of Train Seat has been completed. In such case, the Member shall be deemed to have received said notification.

[Refund Due to Cancellation of Reserved Seat Tickets]

Article 14

  1. By operating information terminals by themselves on the Booking Website, Members can cancel an online booking that is no longer needed and request a refund of the amount paid, up to one (1) minute before the departure time of the reserved seat train for which online booking has been made, which is indicated on the timetable of the boarding station.
  2. The refund shall be simultaneously made for all seats for each purchase number, and a refund fee of 170 yen shall be collected for each purchase number.
  3. The refund shall be made using the same payment method as that used to purchase reserved seat tickets, and if points have been used to cover the payment amount, those points shall be returned.
  4. The refund fee stipulated in Paragraph 2 shall be collected by deducting the amount of the fee from the amount to be refunded. If points have been used to cover the full payment amount, the refund fee shall be collected by deducting the points equivalent to the amount of the refund fee from the points to be returned. If points have been used to cover part of the payment amount, the refund fee shall be collected by deducting the amount of the refund fee from the amount to be refunded, but if the amount to be refunded is less than the refund fee, the refund fee shall be collected by deducting the points equivalent to the amount short of the refund fee from the points to be returned.
  5. The Company shall give notification by email to the email address registered in the Common ID membership information of the Member for whom the handling of a refund has been completed. In such case, the Member shall be deemed to have received said notification.
  6. Notwithstanding Paragraph 1, no refund can be made if reserved seat tickets are purchased by credit card payment and if the credit card used for the payment has expired at the time of cancellation of online booking.

[Refund Due to Delay, Inoperability, or Car Defects]

Article 15

  1. In the event of delay or inoperability of a reserved seat train for which online booking has been made or defects in a reserved seat car of such train, the Company can cancel the online booking made by a Member. In such case, the Company shall automatically refund the full amount paid by the Member without any fee.
  2. The refund shall be made simultaneously for all seats for each purchase number.
  3. The refund shall be made using the same payment method as that used to purchase reserved seat tickets, and if points have been used to cover the payment amount, those points shall be returned.
  4. The Company shall give notification by email to the email address registered in the Common ID membership information of the Member for whom the processing of a refund stipulated in Paragraph 1 has been completed. In such case, the Member shall be deemed to have received said notification.

[Refund Due to Delay or Inoperability of a Connecting Train]

Article 16

  1. If Members fail to arrive in time for the departure of a reserved seat train for which online booking has been made due to delay or inoperability of a connecting train, they can request a refund of the amount paid without any fee by operating information terminals by themselves.
  2. The refund shall be made simultaneously for all seats for each purchase number.
  3. The refund shall be made using the same payment method as that used to purchase reserved seat tickets, and if points have been used to cover the payment amount, those points shall be returned.
  4. The request for refund as stipulated in Paragraph 1 shall be made by email to the Company’s email address provided separately, and such request shall be accepted until noon on the day following the boarding date of the reserved seat ticket that could not be used.
  5. Even if the Company receives a request for refund pursuant to the preceding paragraph, it shall not make a refund if it cannot confirm a delay or inoperability of the connecting train.
  6. The Company shall give notification by email to the email address registered in the Common ID membership information of the Member for whom the processing of a refund stipulated in Paragraph 2 has been completed. In such case, the Member shall be deemed to have received said notification.

[Confirmation of Online Booking]

Article 17

  1. By operating information terminals by themselves on the Booking Website, Members can confirm the information on the purchase of reserved seat tickets on the information terminal screen for up to two (2) years after the boarding date.

[Boarding a Reserved Seat Car]

Article 18

  1. When boarding a reserved seat car, it shall be necessary to always carry an item showing the ticket information, such as an information terminal or a printed booking confirmation email, and present the ticket information when requested by a staff member.

[Granting of Points]

Article 19

  1. The Company shall grant points to Members who purchase reserved seat tickets through the Service in accordance with the calculation method stipulated in Articles 20 and 21.
  2. Points stipulated in Paragraph 1 shall be granted within the day following the boarding date.
  3. Notwithstanding the preceding paragraph, the date on which points are granted may be changed due to operational circumstances of the Company.

[Calculation of Basic Points]

Article 20

  1. When reserved seat tickets are purchased, points equal to 2% of the seat reservation fees (rounded down to the nearest whole number) shall be granted.

[Calculation of Specific Points]

Article 21

  1. Notwithstanding the preceding Article, specific times, periods, sections, etc. (hereinafter, “Applicable Conditions”) may be specified, and points different from those provided in the preceding Article may be granted for the purchase of reserved seat tickets that fall under such conditions.
  2. Applicable Conditions stipulated in the preceding paragraph and the point calculation method shall be notified in advance by posting them on the website or by other appropriate means.
  3. Regarding Applicable Conditions stipulated in Paragraph 1, multiple conditions that overlap in time, period, section, etc. may be specified.

[Expiration Date of Points, etc.]

Article 22

  1. Points have no expiration date; provided, however, that they shall automatically expire in any of the following cases:
    • (1) When two (2) years have passed since the last login to the Booking Website;
    • (2) When a Member withdraws from a Common ID membership; or
    • (3) When the use of a Common ID is suspended or a Common ID membership is forfeited.
  2. Points can only be used to cover the payment amount in accordance with Article 11 and cannot be exchanged for cash.

[Suspension of the Service, etc.]

Article 23

  1. The Company can suspend or discontinue the provision of all or part of the Service without prior notice to Members in any of the following cases:
    • (1) When urgent inspection or maintenance work is performed on any system related to the Service;
    • (2) When the normal operation of the Service becomes impossible due to failure of computers or communication lines, etc., excessive concentration of access, or other reasons;
    • (3) When the operation of the Service becomes impossible due to force majeure, such as natural disasters, riots, or labor disputes; or
    • (4) In other cases where the Company deems it necessary to suspend or discontinue the Service.

[Disclaimer]

Article 24

  1. The Company shall not be liable for any damage arising out of defective display on information terminals or failures caused by environmental settings in the use of the Service.
  2. If the Service cannot be used due to the usage environment, the Company shall not be liable for any damage arising from failures of the communication environment or the Booking Website that are not caused by the Company, unless there are reasons attributable to the Company.
  3. The Company shall not be liable for any transaction, communication, dispute, etc. between Members and third parties arising out of or in connection with the use of the Service.

[Changes to the Terms and Termination of the Service]

Article 25

  1. If the external environment, such as the economic situation, changes, if there is any change in the Company’s business conditions, or if there is any other reasonable need, the Company can change the content of the Service. Additionally, the Company can terminate the provision of the Service for any reason.
  2. If the content of the Service is to be changed or the Service is to be terminated pursuant to the preceding paragraph, such change or termination shall be notified in advance by posting the information on the Company’s website or by other appropriate means.

[Governing Law]

Article 26

  1. These Terms shall be governed by the laws of Japan.

[Elimination of Anti-social Forces]

Article 27

  1. Members shall represent and warrant that they are not and will not be an organized crime group or other anti-social forces and that they are not and will not be affiliated with or under the control or influence of anti-social forces.

[Jurisdiction]

Article 28

  1. In the event of any dispute between a Member and the Company arising out of or in connection with the Service, such dispute shall be resolved through good-faith consultation between the Member and the Company.
  2. If the dispute cannot be resolved even after consultation, it shall be subject to the exclusive jurisdiction of the Osaka District Court.
